Full-Time/Part-Time Employees
Full-time and part-time employees are entitled to the following leave types:
- Annual Leave: Employees accrue four weeks of paid annual leave per year, based on their ordinary hours of work. Part-time employees accrue leave on a pro-rata basis. Annual leave accumulates from the first day of employment, and any unused leave rolls over from year to year; it is not a "use it or lose it" entitlement. Under certain conditions, employees may cash out a portion of their accrued annual leave, provided they retain a minimum balance of at least four weeks after cashing out. Each cash-out agreement must be made in writing, and an employer cannot force or pressure an employee to cash out annual leave.
- Personal/Carer's (Sick) Leave: Employees are entitled to 10 days of paid personal/carer's leave annually, which can be used for personal illness or to care for immediate family members. Part-time employees accrue this leave on a pro-rata basis. Unused personal/carer's leave accumulates from year to year; there is no requirement to use it within a specific period. This leave cannot be cashed out.
- Family and Domestic Violence Leave: All employees, including full-time and part-time, are entitled to five days of unpaid family and domestic violence leave per year. This leave does not accumulate from year to year; it resets annually. This leave cannot be cashed out.
- Long Service Leave: Employees are entitled to long service leave after a prolonged period of continuous service with the same employer, with specific entitlements varying by state and territory. For example, in New South Wales, employees are entitled to two months' leave after 10 years of continuous service. Unused long service leave can usually be carried over, and specific provisions depend on state or territory legislation.
- Public Holidays: Employees are entitled to be absent from work on public holidays applicable in their state or territory without loss of pay. If required to work on a public holiday, they may be entitled to penalty rates as specified in the relevant award or agreement.
Casual Employees
Casual employees are entitled to the following leave types:
- Family and Domestic Violence Leave: Casual employees are entitled to five days of unpaid family and domestic violence leave per year. This leave does not accumulate from year to year; it resets annually. This leave cannot be cashed out.
- Long Service Leave: In some states and territories, long-serving casual employees are eligible for long service leave. Eligibility and entitlements vary by jurisdiction. This leave cannot be cashed out.
